Privacy Policy

Protecting your privacy is really important to us. Accordingly, we’re providing this Privacy Policy to explain our practices regarding the collection, use and disclosure of information that we receive through the PowerBell mobile application known from now on as the PowerBell app. This Privacy Policy doesn’t apply to any third-party websites, services or applications, even if they are accessible through our PowerBell app. Also, please note that, unless we define a term in this Privacy Policy, all capitalised words used in this Privacy Policy have the same meanings as in our Terms of Service. So, please make sure that you have read and understand our Terms of Service.

IN GENERAL

We, the team of Bitello Studio, email address: feedback@powerbell.app (“Email Address”), process your personal data when you use our app (“App”) or website (“Website” and, together with the Apps, “Products”). The processing of your personal data takes place in compliance with applicable local data privacy laws, e.g. the EU General Data Protection Regulation (“GDPR“) or the Romanian data protection act in its current form.

In this privacy policy (“Privacy Policy”) we want to provide you with information about us, the nature, scope and purposes of the data processing, e.g collection and use, giving you insights into the processing of your personal data.

SHARING OF PERSONAL DATA

General

We share data with third parties

We attempt to notify you about legal demands for your data when we think it is appropriate, unless prohibited by law or court order, or when the request is an emergency. We may dispute such demands when we believe that the requests are overbroad, vague or lack proper authority. Special categories of personal data, such as heart rate data or other health data, will never be shared with advertisers or similar agencies.

Service Providers Service Providers. We share your information to others who help us provide and improve our Products (e.g. maintenance, analysis, audit, payments, fraud detection, marketing and development). Service providers will have access to your information as reasonably necessary to perform these tasks on our behalf, and are obligated not to disclose or use it for other purposes.

Data Selling. We do not sell any of your personal data to third parties.

HOW LONG WE STORE DATA

Retention Period. We need to maintain your data for as long as you have an account with us. If you are a user within the EU and you stop using our services without requesting to delete your data, we will keep it for 25 months after your last interaction with any PowerBell. Beyond that, we only store data, if it is legally necessary (because of warranty, limitation or retention periods) or otherwise required.

Account Deletion. If you decide to delete your account, all data PowerBell has about you will be deleted, with the following exceptions:

Any data required for PowerBell’s performance of contractual obligations or compliance with statutory retention obligations shall not be deleted, but minimized to the necessary extent.

A deletion request does not affect data, if the storage is legally necessary, for example for accounting purposes.

WHICH RIGHTS YOU HAVE

Exercise your Rights. To exercise your rights defined in sections 7.2 to 7.8, please send a request via email to the Email Address or via mail to our postal address.

Revocation of Consent. You can revoke your consent – in those cases where consent for processing is necessary – for future data processing at any time. However, this does not affect the lawfulness of data processing based on the consent before the revocation. In certain cases, we may continue to process your information after you have withdrawn consent, if we have another legal basis to do so or if your withdrawal of consent was limited to certain processing activities.

Right of Access. You have the right to obtain (i) confirmation as to whether or not your data is being processed by us and, if so, (ii) more specific information on the data. The more specific information concerns, among other things, processing purposes, categories of data, potential recipients, or the duration of storage.

Right to Rectification. You have the right to obtain the rectification of inaccurate data concerning you from us. In case the data processed by us is not correct, we will rectify these without undue delay and inform you of this rectification. Please note that (i) you can rectify much of your information in the settings and (ii) it is not technically possible for us to rectify all kinds of data in our Product.

Right to Erasure. You have the right to delete data we store about you. Should you decide to do so, please go to your account settings on the Website and delete your account there. If you are unable to do this, please contact us via the email address. As a safety measure, we will send you an email in order for you to confirm this deletion. We will delete your data after this confirmation. Please note that your phone may still have data stored on it after deletion of your account.

Right to Restriction Processing. You have the right to obtain a restriction of processing of your data from us in the following cases:

Right to Data Portability. You have the right to (i) receive a copy of your Data in a structured, commonly used and machine-readable format and (ii) transmit those data to another controller without hindrance from us. You can download a copy of your data in your account settings in the App.

Right to Object. You have the right to object at any time to the processing of data for which our legitimate interests are the legal basis, including profiling based on those provisions. You also have the right to object to processing of data for direct marketing purposes.

Right to File a Complaint. You have the right to file a complaint with your local supervisory authority, if you think that the processing of data infringes applicable law.

How do we collect information

The information we collect is done automatically through out your usage of the PowerBell app. This information is collected through third party services and used to improve the features we offer and your experience in the app.

Information we may collect from you

Our primary goals in collecting information are to provide and improve our PowerBell app, to enable you to enjoy and easily navigate our PowerBell app. All information we collect is anonymous and can’t be used to identify you. Information is used and collected as follows:

On PowerBell for iOS:

In order to use the PowerBell app we do not need or ask for any account information. You don’t have to log in or provide any personal information. To fully benefit from the PowerBell app you can use your iTunes Account as well as your iCloud Account, both of which are subject to Apple’s Privacy Policy and we do not have access to any information from those accounts, we do not track or store any details from these account nor the contents of them. Your iCloud Account is private and can be accessed only by you. We also do not have access to your iTunes and iCloud id’s those are private only to you.

On PowerBell for Android:

In order to use the PowerBell app we do not need or ask for any account information.

Tracking Information

In order to offer you the best possible service, we track anonymous Device Information like operating system, device type, and system performance information. This helps us identify bugs and better understand how they appear in regards to those Device characteristics. We store this information using third party mobile technologies as described below( in the “Third party mobile technologies tracking” section).

Collaboration with third-party data collectors

We also may partner with certain third parties to collect, analyse, and use some of the information described in this section. For example, we may allow third parties to use an application software development kit (SDK) to collect information. An SDK is a section of code that we embed in our mobile app to allow third parties to collect information about how users interact with the app. The information collected by third parties using these technologies may be used for a variety of purposes, including analytics and targeted interest-based advertising, as discussed below (see the section entitled “Third party mobile technologies tracking”).

Anonymous Personal Data

In an ongoing effort to better understand and serve the users of the PowerBell App, we may conduct research on our end users' behaviour based on the anonymous information provided to us. This research does not identify you personally. We may share this de-identified data with our affiliates, agents and business partners. We may also disclose aggregated user statistics (which also do not identify you) in order to describe our services to current and prospective business partners, and to other third parties for other lawful purposes.

Third party mobile technologies tracking

PowerBell app uses GDPR compliant third-party technologies to automatically gather anonymous information about your activity within the app in order to improve the service by detecting bugs and app improvement opportunities as well as for marketing and statistical information. Information gathered by these technologies are not stored in any way by the PowerBell app only by the third-party services used.The shared aggregated information and non-identifying information with third-party services is for industry research and analysis, demographic profiling and other similar purposes. All the third-party services used in the app as well as their purpose are described below:
